On July 26, 1908, Attorney General Charles J. Bonaparte (serving under President Theodore Roosevelt) issued a departmental order creating a small team of special agents inside the Department of Justice.
There was no statute passed by Congress establishing a “Federal Bureau of Investigation.”
Bonaparte simply reassigned DOJ investigators from other agencies (mainly Treasury and Secret Service) to form what he called the Bureau of Investigation (BOI).
