Birthright citizenship is the legal principle that nearly anyone born within the territory of a country automatically becomes a citizen of that country, regardless of their parents’ immigration or citizenship status

In the United States, birthright citizenship is guaranteed by the Citizenship Clause of the Fourteenth Amendment to the Constitution. Adopted in 1868, the amendment states:

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Also known as jus soli (Latin for “right of the soil”), this means physical birthplace determines citizenship. The Supreme Court affirmed (1898) that the Fourteenth Amendment guarantees birthright citizenship to children born in the U.S., even if their parents are not citizens. The few individuals excluded from this guarantee include children born to foreign diplomats (who are not subject to U.S. jurisdiction) and children born in certain U.S. territories, such as American Samoa, where individuals are instead classified as non-citizen nationals.

On 30 June 2026, the U.S. Supreme Court issued a major ruling in the case of Trump v. Barbara. The 6-3 decision struck down a Trump administration executive order that had attempted to deny automatic citizenship to children born in the U.S. to undocumented parents or those on temporary visas. The Court reaffirmed that the Fourteenth Amendment applies universally to nearly all alien individuals born on American soil.

EDITOR’S NOTE: A baby born in the U.S. is automatically an American citizen. However, Iran legally considers the child to be an Iranian citizen. Under Iran’s nationality law, anyone born to an Iranian father is automatically Iranian, regardless of the child’s place of birth. Because both countries claim the child, the baby will have dual citizenship at birth. Iran does not officially recognize dual citizenship. When the child is inside Iran, the government views them solely as an Iranian citizen. This applies for other countries as well.
