Supreme Court slapped Obama down with 23 unanimous decisions against him – Not So Rare

The left wrings their hands over the 9 to 0 Supreme Court ruling. Attacks on individual justices ratchet up. If only they could get rid of some of the conservative justices. Yet the facts bely that it is the only problem. Let’s look back at the Obama regime and how the Supremes ruled. 23 to Zip and he had two of his picks on the court for some of it.

ABC News claimed the unanimous ruling in favor of Trump was “a rare moment.” The Supremes don’t have an issue when the cases that come before it are egregious and a miscarriage of justice by the lower courts. When looking at Obama court unanimous rulings how can one think otherwise?

Let’s set the stage:

Back to Obama- I did the first post on this back on June 24 2016.

It doesn’t count all of the cases of Obama over reaching that never made it to the top court. These cases have nothing in common, other than the government’s view that federal power is virtually unlimited. Stunning the number of unanimous decisions that went against him

In the first 6.5 years of Obama’s presidency (January 2009 to June 2015), the government lost unanimously at the Supreme Court 23 times, an average of 3.62 cases per year.

And that record has only grown in the last few months. This week the government suffered its fifth unanimous loss of the year – matching its dubious achievement in 2013 with 25 cases still left to be decided – in a property-rights case in which Cato filed an amicus briefU.S. Army Corps of Engineers v. Hawkes Co.

Earlier this year, I documented the Obama administration’s abysmal results before the Supreme Court (the two Obamacare cases excepted). Not only is its overall winning percentage much worse than any other modern presidency, but its spate of unanimous losses is truly record-breaking.

These cases have nothing in common, other than the government’s view that federal power is virtually unlimited: Citizens must subsume their liberty to whatever the experts in a given field determine the best or most useful policy to be. If the government can’t get even one justice to agree with it on any of these unrelated cases, it should realize there’s something seriously wrong with its constitutional vision.

  • In the first 6.5 years of Obama’s presidency (January 2009 to June 2015), the government lost unanimously at the Supreme Court 23 times, an average of 3.62 cases per year.
  • In all 8 years of George W. Bush’s presidency, the government lost unanimously 15 times (1.875 cases per year).
  • In all 8 years of Bill Clinton’s presidency, the government lost 23 times (2.875 cases per year).
  • In other words, Obama has lost unanimously twice as often as Bush and 1.5 times as often as Clinton. Obama also passed Bush’s 8‑year total in less than 5 years.
  • The Justice Department’s unanimous loss rate from 2012 to 2014 was especially bad — 13 cases in 30 months — almost three times Bush’s overall rate and almost twice Clinton’s (and that doesn’t count amicus litigating positions with unanimous losses).

Perhaps the Supremes are more united then we think when the rubber meets the road. When they rely on the constitution for their rulings.
