Supreme Court limits gender options on US passports to male and female, supporting President Trump’s stance.
The Supreme Court ruled on Thursday to allow the Trump administration to require the sex designation on passports to align with the traveler’s biological sex.
“Displaying passport holders’ sex at birth no more offends equal protection principles than displaying their country of birth — in both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment,” the court said in an unsigned order.
The State Department can continue issuing passports in one of only two sexes: male and female. It’s a temporary decision, but—as the majority opinion said, “the Government is likely to succeed on the merits” (Supreme Court).

Amy Howe at SCOTUS Blog: In a brief, unsigned opinion, the court granted the government’s request to temporarily put on hold rulings by a federal judge in Massachusetts that would have required the State Department to issue passports to transgender and nonbinary Americans that reflect the sex designation of their choosing. “Displaying passport holders’ sex at birth,” the majority said, “no more offends equal protection principles than displaying their country of birth—in both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment” (SCOTUS Blog).
