Wacko Judge Telling Trump And Congress They Can’t Defund Planned Parenthood Goes More Wackadoodle

I rarely blog about abortion, but, sometimes there’s something that is super moonbat. Like

(CBS News) A judge on Monday temporarily barred the Trump administration from revoking Medicaid funding for Planned Parenthood, partially freezing a provision of the One Big Beautiful Bill Act just days after President Trump signed it into law.

The temporary restraining order by U.S. District Judge Indira Talwani lasts 14 days and directs the Department of Health and Human Services to “take all steps necessary to ensure that Medicaid funding continues to be disbursed” to Planned Parenthood. The ruling, which came after a lawsuit from Planned Parenthood, doesn’t apply to any other health care providers.

The lawsuit takes aim at a portion of Mr. Trump’s signature domestic policy bill that would cut off any federal Medicaid funding to groups “primarily engaged in family planning services, reproductive health, and related medical care” that provide abortions.

So, basically, a law passed by the duly elected Legislative Branch and signed by the duly elected head of the Executive Branch is supposed to be overruled by one rogue judge? Even if Talwani had the authority to do this it would only apply to her district, that of Massachusetts. But, really, where does it say in the Constitution that private companies must be funded for abortion, particularly when said company makes $1.5 billion a year gross? Oh, wait, she wants to triple dog dare moonbat

She needs to be impeached. Even if the Democrats in the Senate will never vote to boot her, it will jam her up for months

(Reuters) But in light of the Trump administration’s request, she issued a new, amended temporary restraining order, opens new tab making clear that she had concluded Planned Parenthood was likely to succeed in proving the law violated the U.S. Constitution.

I cannot see any part of the 1st that applies. Nor on the 5th

Talwani said as a result, the law burdened the right of Planned Parenthood’s 47 members to associate with each other and their parent organization, which advocates in favor of reproductive health care policies, in likely violation of the U.S. Constitution’s First Amendment.

“The Supreme Court has ‘long understood as implicit in the right to engage in activities protected by the First Amendment a corresponding right to associate with others’ in pursuit of desired political, educational, or social ends,” she wrote, citing a 1984 Supreme Court ruling.

They’re welcome to associate with the others. What they are not welcome to is taxpayer money for their operations. Congress has the Constitutional power to determine what to fund and what not to fund. Government programs have no rights except those specifically mentioned in Article I sections 8-10.
