A new traffic safety study from the Law Offices of James A. Welcome has revealed an unexpected but alarming trend on American roads: the most dangerous driving maneuver isn’t an illegal turn, high-speed lane change, or reckless merge; it’s simply going straight.

Using the latest data from the National Highway Traffic Safety Administration (NHTSA), the study analyzed pre-crash driver behaviors in fatal traffic incidents across all 50 states, uncovering the routine moments that often lead to tragedy.


Top 10 States with the Highest Fatal Crash Rates

The study highlights the 10 states with the highest number of drivers involved in fatal crashes per 100,000 residents. Leading the nation is Mississippi, with a staggering 32.39 fatal crashes per 100,000 residents, followed by Wyoming (28.52) and New Mexico (28.42). Rounding out the top five are South Carolina (28.10) and Arkansas (27.86).

Despite differences in geography, population, and infrastructure, one behavioral pattern unites all high-fatality states: most drivers were going straight just before the crash.

  • Mississippi: 3,387 drivers fatally crashed while going straight

  • South Carolina: 5,116

  • Alabama: 4,254

  • Tennessee: 5,455

  • Texas: 18,456

“It’s the kind of stat that makes you do a double-take,” said a spokesperson for the firm. “We expect dangerous crashes to involve complex maneuvers or bad weather, but in reality, the most fatal moments on the road often occur during routine, straight-line driving.”


What’s Really Happening Behind the Wheel?

The prevalence of fatal crashes during straight-line driving is often linked to driver inattention, fatigue, speeding, or impairment — rather than the action itself. These incidents tend to happen on familiar roads, where drivers feel most comfortable and may let their guard down.

Second and third most common fatal crash actions included:

  • Negotiating a curve – often with excessive speed, especially in rural states

  • Turning left – a challenging maneuver that requires judgment and timing

These findings point to systemic safety gaps on America’s roadways — particularly on rural highways where emergency response times are slower and road designs are often outdated.


The Safer States Still Share the Same Risk

Even in states with the lowest crash rates, like Massachusetts (7.38 per 100k) and New York (7.53 per 100k), “going straight” still tops the list of pre-crash actions.

  • New York: 4,468 drivers involved in fatal crashes while going straight

  • Massachusetts: 1,850

  • New Jersey: 2,741

“This consistency across the board tells us it’s not just a ‘Southern’ or ‘rural’ issue — it’s a behavioral one,” said the firm’s spokesperson. “Distraction and complacency during simple driving moments can be just as deadly as reckless driving in complex situations.”


Policy Recommendations and Safety Takeaways

Based on the data, the study recommends:

  • Increased driver education around attention during “routine” driving

  • Infrastructure improvements to curves and intersections in high-fatality states

  • Enhanced use of driver-assist technologies like lane-departure warnings and collision avoidance systems

The firm also calls for public awareness campaigns reminding drivers that safety must be a constant priority — especially on familiar routes where attention tends to wane.

The Law Offices of James A. Welcome analyzed fatal crash data from the NHTSA’s Fatality Analysis Reporting System (FARS) to identify the most common driver actions before fatal crashes. Rates were calculated per 100,000 residents for fair comparison.
