War crimes are serious violations of international humanitarian law that occur during armed conflict, and they are defined primarily through the Geneva Conventions of 1949 and their Additional Protocols. The most serious violations, known as “grave breaches,” are explicitly outlined in the Geneva Conventions and include acts such as willful killing, torture or inhumane treatment (including biological experiments), wilfully causing great suffering or serious injury to body or health, extensive destruction and appropriation of property not justified by military necessity and carried out unlawfully and wantonly, compelling a prisoner of war or other protected person to serve in the forces of a hostile power, wilfully depriving a prisoner of war or other protected person of the rights of fair and regular trial, unlawful deportation or transfer or unlawful confinement, and taking of hostages.

These grave breaches apply to protected persons, including prisoners of war, the wounded, sick, shipwrecked, and civilians, and are considered war crimes under international law. The United States, through its Crimes Against Humanity and War Crimes Act, defines war crimes similarly, including grave breaches of the Geneva Conventions and other serious violations of the laws and customs applicable in international armed conflict. The Rome Statute of the International Criminal Court also defines war crimes as grave breaches of the Geneva Conventions, and the ICC has jurisdiction over such crimes when committed in the context of international or non-international armed conflicts.

In addition to the Geneva Conventions, other international legal instruments such as the Hague Convention IV of 1907 and the Protocol on Prohibitions or Restrictions on the Use of Mines, Booby-Traps and Other Devices further define prohibited conduct, including the use of poison or poisoned weapons, asphyxiating or poisonous gases, weapons causing superfluous injury or unnecessary suffering, and the use of enemy flags or uniforms to deceive, which constitutes perfidy. The doctrine of universal jurisdiction allows any state to prosecute war crimes regardless of where they were committed or the nationality of the perpetrator or victim, reflecting the view that such crimes are of concern to the entire international community.

The prosecution of war crimes is carried out by national courts, international tribunals, mixed tribunals, and the International Criminal Court, especially when national systems are unable to do so during or after conflict. The principle of individual criminal responsibility ensures that perpetrators, including soldiers and commanders, can be held accountable for their actions, even if they were following orders.
